Hot Water: Liability Rains on Employer After Tragic Workplace Safety Violation

​When an employer violates California workplace safety rules, the California Division of Occupational Safety and Health (known as Cal/OSHA) can seek various administrative penalties. If the violation is willful and involves a worker’s death or permanent impairment, administrative fines can end up in the millions of dollars. Cal/OSHA also can refer matters to the local district attorney for prosecution, and criminal penalties of up to three years’ imprisonment are on the table.​
