Nationwide, nearly 54 percent of nonunion private-sector employers and employees enter into arbitration agreements — where the employer and employee agree to resolve disputes outside of court — according to a 2018 report by the Economic Policy Institute. In California, that number jumps to just over 67 percent, likely due to what the report calls a “relatively employee-protective environment of … employment laws.”
