Editor’s note: This article was updated on June 21, 2023, to clarify that the Berkeley Fair Workweek Ordinance will become operative in January 2024.

Following in the footsteps of San Francisco, San Jose and Emeryville, the cities of Los Angeles and Berkeley recently passed Fair Work Week Ordinances (FWWO), which strengthen protection for workers in certain industries.

In Los Angeles, large-retail businesses with at least 300 employees should closely review the city’s new ordinance, while in Berkeley, various businesses like those in the building services, healthcare, hotel, restaurant and retail industries should familiarize themselves with that municipality’s new ordinance.

The FFWO for the city of Los Angeles will take effect on April 1, 2023, and Berkeley’s FWWO took effect in January 2023, but according to the ordinance’s terms, it won’t become operative until January 2024.
