Only Default PAGA Penalties Apply for Providing Inaccurate Wage Statements, Court Rules

As 2021 was winding down, a California Court of Appeal held that heightened penalties for wage statement violations under Labor Code Section 226.3 are available only when an employer fails to either provide a wage statement or keep adequate records — not when the wage statement is merely inaccurate (Gunther v. Alaska Airlines, Inc., Case No. D076762 (December 1, 2021)).
