This form is based on California Executive Order N-31-20, which temporarily suspends California WARN Act’s 60 days' advance notice requirement for mass layoffs/terminations due to COVID-19 (coronavirus) related reasons, provided the employer complies with certain conditions. The Executive Order is specific to COVID-19 circumstances and does not suspend notice requirements generally. Only use this form to notify affected employees of mass layoffs, relocations or terminations that are directly caused by COVID-19-related business circumstances. Use this form in compliance with Executive Order N-31-20, the State’s implementing guidance and in consultation with legal counsel. Note: The federal WARN Act is still in effect and employers subject to the federal law must still comply with its notice requirements.
