Unless discrimination is shown, an employment practice is lawful if it is required by state or federal law, or if it is pursuant to an order of a state or federal court of proper jurisdiction.1
After you present a legitimate nondiscriminatory reason for your decision, the employee must prove that the reason you gave is a pretext for unlawful discrimination.2
