Employees can file complaints with the Labor Commissioner to recover unpaid wages. The Labor Commissioner has the authority to:1

  • Investigate these complaints.
  • Hold hearings and take action to recover wages.
  • Assess penalties and make demands for compensation.

Within 30 days of filing the complaint, the Labor Commissioner must notify the parties if a hearing will be held. If a hearing will be held, the hearing must occur within 90 days2
