Mandatory Days Off

Generally, employees are entitled to at least one day off in a seven-day workweek, and employers cannot cause employees to go without such a “day of rest.”1 This requirement to provide employees with a day of rest is separate and apart from the requirement to pay weekly overtime.

Employees are entitled to one day of rest in each workweek; they are not entitled to one day off on a rolling basis whenever they work seven consecutive days. Periods of more than six consecutive days that stretch across more than one workweek are not, by definition, prohibited.2
