Can I have an applicant complete an I-9?

You may not ask an individual to complete an I-9 until he or she has accepted a job offer. The same principle holds true for the E-Verify system. It is unlawful and a violation of both federal and state law to use the E-Verify system before an individual has accepted a job offer. It cannot be used to pre-screen employees.
