Do I have to offer COBRA coverage to someone who is on Family/Medical leave?
HRCalifornia
Leave under the Family and Medical Leave Act (FMLA) does not constitute a qualifying event for purposes of COBRA. Moreover, under FMLA, an employer is obligated to continue health and welfare benefits for up to 12 weeks.
COBRA rights generally must be made available after the 12-week FMLA period expires if benefits coverage terminates, even if the employee did not pay the premiums necessary to remain covered while on FMLA leave.
