Outside Salesperson Exemption

​Outside salespeople are exempt from overtime pay, minimum wage, and meal and rest breaks if they meet both of the following criteria:​

  • Are 18 years of age or older
  • Customarily and regularly work more than 50 percent of their working time away from your place of business selling tangible or intangible items or obtaining orders or contracts for products, services or use of facilities

Exclamation content: Outside salespeople do not need to meet the minimum salary requirement that covers the executive, administrative and professional exemptions.
