The ADA requires employees to prove that they are “qualified individuals” and that they can perform the essential job duties before they can establish discrimination.

FEHA requires employees to prove that they are “qualified individuals” just like the federal ADA requires. It places the burden on an employee to prove that he/she is a qualified individual and not on the employer to establish that the employee is not qualified.1
