The EEOC issued Enforcement Guidance: Application of the ADA to Contingent Workers Placed by Temporary Agencies and Other Staffing Firms to clarify how federal disability discrimination laws apply to temporary workers. The guidance covers people who are placed in jobs by staffing firms, such as employment agencies or contract firms. According to the EEOC, these workers often qualify as employees of both the staffing firm and the client. Therefore, both entities bear certain obligations to temporary workers under the ADA and the Rehabilitation Act.
