Employees who are victims, or whose family members are victims may need time off to appear in related legal proceedings for various reasons. Absence from work for victims is protected by law. You cannot deny the employee the time off.

For victims' leave to attend legal proceedings, the law defines "victim" in two different ways depending on the nature of the legal proceeding and the purpose of attending. As such, it's helpful to divide leave for legal proceedings into two main types or categories based on the different definitions:

  • Legal proceedings to serve as a witness or seek relief.
  • Legal proceedings related to specific crimes and victims' rights.
