What You Need to Know

The expanded California Family Rights Act (CFRA) means big policy changes for employers. On September 19, 2020, Governor Gavin Newsom signed SB 1383, effective on January 1, 2021, which significantly expanded the family and medical leave known as the California Family Rights Act (CFRA). Businesses with 5 or more employees will need to either create or update their family and medical leave policy to comply with the latest changes under CFRA.

  • NEW — California Family Rights Act (CFRA) Leave: One of the most drastic legal updates we saw for 2021 was SB 1383, which expanded the California Family Rights Act (CFRA) leave to cover all employers with five or more employees, a significant change from its previous coverage of employers with 50 or more employees. The new CFRA policy also addresses the expanded qualifying reasons for which an employee may take CFRA leave.

  • NEW — Family and Medical Leave Act (FMLA) Leave: Given the SB 1383 CFRA expansions, the FMLA policy was separated from what was previously called the “Family and Medical Leave” policy and made into a standalone policy.

  • NEW — Diversity, Equity, and Inclusion: Our new Diversity, Equity, and Inclusion policy allows you to demonstrate your commitment to fostering a diverse workforce and maintaining an equitable and inclusive work environment. 

  • REVISED — Telecommuting Policy: COVID-19 took the workplace offsite and into remote locations. Because telecommuting significantly increased this year, we updated the Telecommuting Policy (previously referred to as the “Remote Workers” policy) to account for the evolving workplace environment.
