During much of the COVID-19 pandemic’s second year, vaccines in the workplace dominated the discussion — and current litigation is centered around several related questions: Can we mandate vaccines? Should we? Are there exceptions?
These many questions had no easy answers and even less court guidance — but this changes with the California Court of Appeal’s recent decision upholding an employer’s actions regarding its flu vaccine mandates (Hodges v. Cedars-Sinai Medical Center, Case No. B297864 (April 28, 2023)).
Although this case involved a flu vaccine mandate, its lessons and guidance could potentially be applied to other vaccine mandates, including for COVID-19.
