The CFRA and the FMLA don't apply to every employer. They apply only to employers of a certain size, measured by how many employees they have. In the past, both the CFRA and FMLA applied to employers of the same size, but, beginning in 2021, California expanded the CFRA’s coverage. The following sections discuss employer coverage requirements and issues under both laws.
